2. DESCRIPTION OF SERVICE

PixPro provides collection of professional stock-photographs, artwork, and cartoons to the target segment like Advertising agencies, Print Media, Web-Design Companies etc. PixPro also provides functionality for the customers to order cartoons as per their requirement.

Customers can buy high-resolution images that are categorized and sub-categorized for easy browsing. Customers can also search using search and advanced search options provided.

Search can be made on the following fields.

1.   Name match on the photographs name and description.

2.   Country

3.   Type of work like Photographs, Cartoons, artwork etc.

4.   Location etc.

PixPro is promoted by Vivegam Techonologies, which has another portal kalvitv.com.

In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.

4. MEMBER CONDUCT 

PixPro.in does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using this Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will PixPro.in be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Service.

You agree to indemnify and hold PixPro.in, and its sister companies and its parent companyVivegam Techonologies, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to failure of this service, your use of the Service, your connection to the Service.

7. NO RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

 

8. GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge that PixPro.in may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that Photographs, Other postings or other uploaded Content will be retained by the Service, You acknowledge that PixPro.in reserves the right to remove unread postcard or read postcards that are inactive for an extended period of time. You further acknowledge that PixPro reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

 

9. MODIFICATIONS TO SERVICE

PixPro.in reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that PixPro.in shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

PIXPRO.IN MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY SERVICES, INFORMATION, OR OTHER MATERIAL WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. 

c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

12. LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT PIXPRO.IN SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES  RESULTING FROM:

(i) THE USE OR THE INABILITY TO USE THE SERVICE

(ii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (iii) ANY OTHER MATTER RELATING TO THE SERVICE.

 

 

 13. TERMS FOR THE END CUSTOMERS USAGE

  I agree to the following terms and conditions set by PixPro.in.

            1. I have agreed that when i buy content from PixPro.in and will use it with offending any laws and if there are any problems PixPro.in will not be liable.

            2. I have agreed that in the get your cartoon function - when i ever i upload the images there will be a time lag to get the cartoons though PixPro.in will make every efforts to give the content as soon as possible

 13. TERMS FOR THE ARTISTS USAGE

 

I agree to the following terms and conditions set by PixPro.in.

 

1. I have agreed to upload the images/art work/cartoons of my own work only.

2. I have agreed to the revenue sharing as per the registeration process or as agreed and approved by the Pixpro.in

3. I have agreed that in the get your cartoon function - when i ever i upload the cartoons it has to satisfy the customers expectations and when customer rises some issues, i will solve it amicably though it may not be related to non-payment of artists revenue share, PixPro.in might ask the artist to redraw for the customer or reassign the request to some other artist.

4.I have agreed that i will upload only images or cartoons or artwork which maynot offend any person or any community specifically. When any issues come up PixPro.in has every right to hide the images and future buying of these images by end-customers.

5. I have agreed that the revenue share will be sent to my account directly or thru cheque payment on a monthly basis.

6. I have agreed that the images may be sold collectively and proportionate revenue share will only be received by me.

7. I have agreed that PixPro.in may offer some discount in the form coupons or seasons discount etc. to promote the sales and i agree that i will receive only the share from the sold out price not the original price.

8.I have agreed that when an image is bought out on exclusive basis by a customer, it cannot be bought by other customers during that exclusive period.

15. OTHER LEGAL INFORMATION

These Terms of Use shall be governed by Chennai Jurisdiction and construed in accordance with the laws prevailing in India.

These Terms of Use contain the entire understanding of the parties here to relating to the use of this Site and supersedes any prior written or oral agreement or understandings between the parties with respect to this Site, and cannot be changed or terminated orally. The invalidity or unenforceability of any provision of these Terms of Use will not affect the validity or enforceability of any other provision of these Terms of Use. PixPro.in reserves the right to terminate these Terms of Use without notice if, in its sole discretion, you fail to comply with any of these Terms of Use. Upon termination,In addition, PixPro.in reserves the right to terminate this site without notice.
